By creating an account or using Spark Dating, you agree to be bound by these Terms & Conditions. Please read them carefully before using our services.
By registering, accessing, or using Spark Dating ("the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and our Community Guidelines. If you do not agree, you must not use the Platform.
You must be at least 18 years of age to use Spark Dating. By creating an account, you represent and warrant that: (a) you are at least 18 years old; (b) you have the legal capacity to enter into a binding agreement; (c) you are not prohibited from using the Platform under any applicable laws; (d) you have not been previously banned from the Platform; (e) you will provide accurate, current, and complete information during registration.
You agree to provide truthful and accurate information during registration including your name, email, phone number, and gender. You are solely responsible for maintaining the confidentiality of your account credentials. Optional identity verification (Aadhaar, PAN card, selfie verification) is encouraged but not mandatory for basic accounts. By submitting government identification, you consent to its use solely for verification purposes as described in our Privacy Policy.
Spark Dating is an online platform that facilitates introductions between users. THE PLATFORM DOES NOT GUARANTEE ANY OUTCOMES, INCLUDING BUT NOT LIMITED TO: finding a romantic partner, the accuracy of user profiles, the character or intentions of other users, the success of any interaction or relationship. Spark Dating acts solely as an intermediary platform and is NOT responsible for the actions, behavior, conduct, or statements of any user, whether online or offline.
YOU ACKNOWLEDGE AND AGREE THAT SPARK DATING SHALL NOT BE LIABLE FOR: (a) any damages, losses, or harm arising from interactions between users; (b) any fraudulent, misleading, or deceptive behavior by other users; (c) any physical, emotional, psychological, or financial harm resulting from meetings or relationships formed through the Platform; (d) any criminal activity by users; (e) any misrepresentation of identity, age, profession, or personal details by users; (f) any disputes between users. Users interact with each other AT THEIR OWN RISK. We strongly recommend meeting in public places and informing trusted individuals about your plans.
You agree to: (a) comply with all applicable laws and regulations; (b) not use the Platform for any unlawful purpose; (c) not harass, threaten, stalk, or intimidate any other user; (d) not transmit obscene, offensive, or sexually explicit content without consent; (e) not create fake or misleading profiles; (f) not use the Platform for commercial solicitation, advertising, or spam; (g) not attempt to extract personal information from other users for unauthorized purposes; (h) not impersonate another person; (i) report any suspicious or illegal behavior to our safety team.
Users retain ownership of content they upload (photos, text, voice recordings). By uploading content, you grant Spark Dating a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content on the Platform. You represent that you own or have the right to share any content you upload. Spark Dating may remove any content that violates these Terms without notice.
Spark Dating offers free and paid subscription tiers. Paid subscriptions (Premium ₹499/month, Elite ₹1,499/month, Spark Club ₹9,999/month) auto-renew unless cancelled before the renewal date. You may cancel at any time from your account settings. Refunds are available within 48 hours of purchase if no premium features were utilized. Prices are subject to change with 30 days notice. All payments are processed through secure third-party payment processors; Spark Dating does not store your payment card details.
Spark Club membership requires application and approval at Spark Dating sole discretion. Approval criteria include but are not limited to profile quality, verification status, and professional background. Membership is non-transferable. Spark Dating reserves the right to revoke membership at any time for violations of these Terms or Community Guidelines, without refund for the current billing period.
Spark Dating provides safety tools including blocking, reporting, and verified badges. However, THESE TOOLS DO NOT GUARANTEE SAFETY. You are solely responsible for your personal safety when interacting with other users. Spark Dating cooperates with law enforcement authorities when required by law. Emergency situations should be reported to local police (112 in India) before contacting our safety team.
Your use of the Platform is also governed by our Privacy Policy. By using Spark Dating, you consent to the collection, storage, and processing of your personal data as described in the Privacy Policy. You may request deletion of your data at any time by contacting privacy@sparkdating.in or through account settings.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPARK DATING, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM. IN NO EVENT SHALL SPARK DATING TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO SPARK DATING IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Spark Dating, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) your interactions with other users.
Any disputes arising from these Terms or your use of the Platform shall be governed by the laws of India. You agree to submit to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India. Before initiating legal proceedings, you agree to attempt resolution through our support team at legal@sparkdating.in.
Spark Dating may suspend or terminate your account at any time, without prior notice, for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately. Sections relating to liability limitations, indemnification, and dispute resolution survive termination.
Spark Dating reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
These Terms are governed by and construed in accordance with the laws of India, specifically the Information Technology Act, 2000, and the Consumer Protection Act, 2019, as applicable.
